These Terms of Service (“Terms”) govern your access to and use of the Habisun mobile application, websites, backend APIs, subscriptions, and related services (collectively, the “Services”).
By creating an account, downloading the App, purchasing a subscription, or using the Services, you agree to these Terms. If you use the Services on behalf of a family, child, organization, or another person, you confirm that you have authority to do so.
1. Eligibility and Parental Responsibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a parent or guardian account. Children may use child-facing features only with the authorization and supervision of a parent or legal guardian.
Parents and legal guardians are responsible for:
- creating and managing child profiles;
- deciding what child information and family content is added to the Services;
- supervising child use of the App;
- obtaining any permissions required under applicable family, education, child privacy, consumer protection, or platform rules;
- ensuring that family members use the Services lawfully and respectfully.
2. Description of the Services
Habisun helps families manage tasks, routines, habits, rewards, wishes, achievements, challenges, growth reports, quadrant boards, family messages, reminders, and related parent-child collaboration workflows. V2 adds or enhances capabilities including, without limitation:
- Custom achievements/badges: create and edit achievement rules, bind tasks or categories, and show unlock progress and memories;
- Voice attachments (Pro/Premium): record and play voice task proof, parent voice instructions, and voice wish reasons;
- Task-bound rewards and direct redemption: coin, designated reward, or mixed reward modes with automated fulfillment where configured;
- AI growth plans (Premium): phased habit-improvement plans, AI clarification and revision, and phase review suggestions (published only after parent confirmation);
- Challenges and streaks: standalone challenge goals, habit streak records, and related incentives;
- Quadrant boards: organize tasks by important/urgent dimensions for parents and children;
- Enhanced reports: category stats, focus data, reward/achievement/streak trends, and AI suggestions where available;
- Daily export and share: generate task list or quadrant PDFs/images with optional privacy masking, save to the photo library, or share through the system share sheet.
Some features may require an internet connection, a supported device, app permissions, a valid account, or a paid subscription (Free, Pro, and Premium plans may differ in available features). After a subscription expires, some AI or advanced features may be limited, but published in-progress plans or data may remain viewable or manageable according to product rules.
We may update, modify, suspend, or discontinue parts of the Services from time to time. We will try to provide reasonable notice for material changes where practical.
2.1 Assistive Tool; No Commitment or Guarantee
Habisun is a family task and parent-child collaboration assistive tool. It provides suggestions, references, and records only. It does not create promises, guarantees, contracts, or legal obligations of any kind.
You understand and agree that:
- the App must not be used as a commitment tool for habit formation, behavior change, learning outcomes, or any other goal; tasks, rewards, achievements, challenges, growth plans, reports, and AI suggestions do not constitute any guarantee or promise of results from us;
- habit and behavior improvement depend on family communication, individual differences, execution context, and parental judgment; we do not guarantee that use of the Services will form habits, improve behavior, or achieve specific parenting or education outcomes;
- in-app rewards, coins, achievements, challenge completion states, and “streaks” are incentive and record tools configured and managed by parents, and do not have legal consideration, warranty, or enforceability;
- AI growth plans and AI suggestions in reports are generated by third-party AI services based on information you provide, are for reference only, and do not constitute medical, psychological, educational, or legal advice; for high-risk topics such as self-harm or abuse, the App may refuse to generate a plan and direct you to professional help;
- if we later offer ceremonial features such as “family agreements,” they are intended as in-family understandings and memories, not legally binding contracts, notarized documents, or enforceable claims against third parties;
- you must evaluate how to use in-app content for family communication and must not treat the Services as behavioral guarantees, punishment grounds, or external commitments for any family member, including children.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials, parent PIN, devices, and family access. You are responsible for activity under your account unless caused by our breach of these Terms or applicable law.
You agree to provide accurate information, keep it up to date, and notify us promptly if you suspect unauthorized access, account compromise, or misuse.
We may refuse, suspend, or terminate access if we reasonably believe that an account is unlawful, unsafe, fraudulent, abusive, violates these Terms, or creates risk to users, children, families, us, or third parties.
4. Family Content and User Content
“User Content” means information, text, images, voice recordings, task proof, reward content, achievement icons, wish descriptions, AI plan drafts and feedback, export/share content, messages, profile information, and other content submitted to or created in the Services by you or your family.
You retain ownership of your User Content. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, and use User Content solely to provide, secure, maintain, and improve the Services and as otherwise described in our Privacy Policy.
You represent that you have the rights and permissions needed to upload or submit User Content, including images of children or family members. Do not submit content that is unlawful, harmful, invasive of privacy, infringing, misleading, or inappropriate for a family service.
5. Subscriptions, Trials, Billing, and Refunds
Habisun may offer free and paid plans. Paid features may be provided through auto-renewing subscriptions purchased through Apple App Store, Google Play, or another authorized channel.
- Billing: Payment is charged by the applicable app store or payment platform at confirmation of purchase.
- Auto-renewal: Subscriptions renew automatically unless canceled according to the app store’s rules, usually at least 24 hours before the current period ends.
- Management: You can manage or cancel subscriptions through your Apple App Store or Google Play account settings.
- Trials and promotions: Trial or promotional access may be subject to additional terms and may convert to a paid subscription unless canceled before the trial ends.
- Price changes: We or the app store may provide notice of subscription price changes as required by platform rules or law.
- Refunds: Refund eligibility is generally controlled by the app store or payment platform used for purchase. We do not receive full payment card details and usually cannot directly issue app store refunds. For users in the European Union, United Kingdom, or other jurisdictions with mandatory statutory cancellation periods or cooling-off rights, you may have cancellation or refund rights under applicable law and app store rules. Nothing in these Terms limits any non-waivable consumer rights you may have.
If a subscription expires, is canceled, refunded, revoked, or cannot be verified, paid features may be reduced or disabled.
6. Acceptable Use
You agree not to:
- violate any applicable law, regulation, court order, or third-party right;
- use the Services for harassment, abuse, exploitation, discrimination, or harmful conduct;
- upload illegal, infringing, deceptive, sexually explicit, violent, hateful, or privacy-invasive content;
- impersonate another person or misrepresent your authority over a child or family;
- attempt to access another user’s account, family workspace, data, systems, or non-public areas;
- interfere with, disrupt, overload, reverse engineer, scrape, crawl, or compromise the Services;
- bypass security, subscription, rate limit, authentication, or access controls;
- introduce malware, spyware, harmful code, or unauthorized automation;
- use the Services to make high-risk decisions where failure could lead to injury, legal harm, financial loss, or other serious consequences;
- treat in-app tasks, rewards, achievements, challenges, AI suggestions, or any future family agreement features as legal commitments, external guarantees, or punishment grounds for habit formation, behavior change, or any outcome.
7. Child Safety and Family Use
Habisun is an assistive family productivity and parent-child collaboration tool, not a substitute for parental judgment, childcare, medical advice, education advice, emergency services, or professional guidance. Parents and guardians remain responsible for decisions about chores, habits, rewards, screen time, discipline, wellbeing, and safety.
You agree to use incentive features respectfully and not to pressure, shame, exploit, endanger, or unlawfully monitor a child or family member; not to use completion status, unredeemed rewards, locked achievements, or AI suggestions as grounds to shame, punish, or threaten a child.
Reminder: the Services are not a commitment tool for habit formation or behavior change; they provide suggestions, references, and records only (see Section 2.1).
8. Third-Party Services and Platforms
The Services may rely on or integrate with third-party platforms, SDKs, stores, cloud services, authentication providers, AI service providers (such as OpenAI), analytics providers, crash reporting services, notification services, and subscription services. AI features are invoked through our backend and inputs you submit may be processed and sent to such providers. These third parties may have their own terms and privacy policies.
We are not responsible for third-party services that we do not control, but we select service providers to support the Services and describe key providers in our Privacy Policy.
9. Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect personal information. By using the Services, you acknowledge the Privacy Policy.
10. Intellectual Property
The Services, including software, source code, designs, interfaces, text, graphics, icons, logos, workflows, content templates, and other materials, are owned by Voxria Tech or its licensors and are protected by copyright, trademark, trade secret, and other laws.
Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Services.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and Services for lawful family use according to these Terms.
11. Feedback
If you send suggestions, ideas, reports, or feedback, you grant us the right to use them without restriction or compensation, provided we do not identify you publicly without your permission.
12. Service Availability and Changes
We work to keep the Services reliable, but we do not guarantee uninterrupted, error-free, or permanently available service. The Services may be unavailable due to maintenance, network issues, third-party failures, security events, app store actions, or circumstances beyond our control.
We may change features, limits, plans, or technical requirements. If a change materially affects paid features during an active subscription period, we will handle it according to applicable law and platform rules.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Services will meet every family need, improve behavior, form habits, produce a specific parenting outcome, prevent disputes, or be suitable for every child.
We do not guarantee the accuracy, completeness, or suitability of AI-generated content; AI output may contain errors, omissions, or content unsuitable for your family. You must review tasks or suggestions before publishing or relying on them.
To the maximum extent permitted by law, we are not liable for unmet expectations, family disputes, or losses arising from treating the Services as a commitment, contractual, or professional advisory tool.
Some jurisdictions give consumers mandatory warranties, remedies, or guarantees that cannot be excluded. Nothing in these Terms limits those non-waivable rights.
14. Limitation of Liability
To the maximum extent permitted by law, Voxria Tech and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.
To the maximum extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of: (a) the amount you paid to us for the Services during the 12 months before the event giving rise to the claim; or (b) USD 100.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability where doing so would be unlawful.
15. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Voxria Tech from claims, damages, liabilities, losses, and expenses arising from your misuse of the Services, your User Content, your violation of these Terms, or your violation of law or third-party rights.
16. Suspension and Termination
You may stop using the Services at any time and may request account deletion as described in the Privacy Policy.
We may suspend or terminate your access if we reasonably believe that you violated these Terms, created risk or harm, failed to pay applicable fees, infringed rights, abused the Services, or used the Services unlawfully. We may also terminate inactive accounts or discontinue the Services subject to applicable law.
After termination, your right to use the Services ends. Certain provisions will survive, including intellectual property, payment obligations, disclaimers, limitation of liability, indemnity, dispute provisions, and miscellaneous terms.
17. Dispute Resolution and Consumer Rights
Before filing a claim, you agree to contact us at support@habisun.com and try to resolve the dispute informally. If we cannot resolve it within a reasonable period, either party may pursue remedies available under applicable law in a court or forum with competent jurisdiction.
Nothing in these Terms limits mandatory consumer protection rights, data protection rights, app store rights, cancellation rights, or remedies that cannot be waived under the laws of your country or region.
18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice through the App, website, app store listing, email, or other means. The updated Terms take effect on the stated effective date. Your continued use of the Services after that date means you accept the updated Terms.
19. Miscellaneous
These Terms and the Privacy Policy form the agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
